TCPA Compliance Checklist for Lead Forms (2026 Update)

A practical review framework for consent language, proof, routing, revocation, and vendor handoffs. Use it with qualified counsel for your specific campaigns and jurisdictions.

OPERATING PRINCIPLE

The form is one moment in a longer compliance workflow.

Use this guide as a working session: compare the recommendation with your actual process, name the owner, and test the change on a representative sample before scaling.

FIELD GUIDE / Compliance

Start with the actual communication plan

Document who will contact the lead, by which channels, for what purpose, using what technology, and whether any partners are involved. Consent copy cannot be evaluated in isolation from the campaign it supports. This guide is operational information, not legal advice; confirm current 2026 requirements with qualified counsel.

Make the disclosure specific and visible

Review whether the disclosure identifies the relevant seller or callers, describes the communication method, explains any automated or prerecorded technology where applicable, and makes clear whether consent is a condition of purchase. Do not hide material terms in a tiny block or behind an unrelated link. Have counsel confirm regulatory requirements for the specific campaign.

Preserve proof at submission

Record the displayed disclosure version, user action, timestamp, source, form version, and submitted contact data. Keep historical evidence immutable even when the live form changes. Restrict access and mask personal fields in routine demos or training.

Route with suppression built in

Before outreach, apply internal do-not-call records, channel permissions, geographic rules, calling windows, duplicate controls, and vendor-specific restrictions. The contact record should show the source and current permission state where the agent works.

Handle revocation as an event

Give people clear ways to revoke permission, and make the stop signal propagate across campaigns and channels as required. Record when the request arrived, what it applied to, and when suppression took effect. Test spelling variants and human-reported requests, not only automated keywords.

Pre-launch checklist

  • Campaign and callers documented
  • Disclosure reviewed by counsel
  • Form version and timestamp preserved
  • Consent choice separated by channel where needed
  • Source and partner handoff recorded
  • Suppression lists applied before dialing
  • Calling windows configured
  • Revocation paths tested
  • Agent scripts aligned with permission
  • Audit and retention owners named

Audit the full chain

Test a submission, duplicate, correction, opt-out, and imported lead. Confirm the CRM, dialer, messaging tools, and partners all receive the correct status. Compliance breaks at handoffs; your audit should follow the record end to end.
